Democrats Win US Senate, Putting CLARITY Act in Doubt
Democrats won at least 51 Senate seats, flipping six Republican-held ones. For the CLARITY Act on crypto market structure, it means a new balance of power in January.

Democrats have won control of the US Senate in the November 3 midterms. CNBC reported that at 11:57 PM ET projections showed Democrats holding at least 51 seats, enough for a majority because Vice President JD Vance casts the tie-breaking vote. For crypto, the key question is what happens to the CLARITY Act on market structure.
Details
Democrats flipped six Republican-held seats: Iowa, Kansas, North Carolina, Ohio, South Carolina and Texas, according to CNBC. NBC News tied the majority to Josh Turek's win over Ashley Hinson in Iowa; counting was not yet finished at that point. Republicans entered election day with 53 of 100 seats.
In Ohio, Sherrod Brown returns to the Senate. CNBC calls him "crypto's nemesis," noting he lost in 2024 after heavy spending against him by the crypto industry. The new Senate takes office in January.
Cointelegraph reports that the CLARITY Act failed a procedural Senate vote in September, 49–50. If it is not passed by January, the next Congress must start over and build bipartisan support. Industry voices quoted by the outlet say nothing will pass without cross-party backing, and that making crypto a partisan issue could set the US back years.
What this means for the market
A change of majority reshuffles committees and the Senate agenda, and with them the terms of any future crypto bill. Democrats may push for tougher ethics rules for officials and more scrutiny of Trump-linked crypto businesses. For now these are expectations, not decisions: no bill or timeline exists. On October 27 Treasury Secretary Scott Bessent said rules could advance through the SEC and CFTC. For the live bitcoin price, see the daily brief.
