SEC Draws About 140 Comments on Regulation Crypto Assets

The public comment period on the SEC's "Regulation Crypto Assets" proposal is wrapping up, with about 140 comments filed on docket S7–2026–27 by organizations and individuals, six of them anonymous, Cointelegraph reports. The letters are posted on the SEC site. Sources give different closing dates (Oct. 19 or 20), so we don't state one.

Details

The SEC unveiled the proposal on Aug. 18, 2026 (Release No. 33–11434, proposal text). It offers token issuers two exemptions from registration: a smaller one capped at $5 million over four years and a larger one of up to $75 million in any 12-month period. The larger exemption requires financial statements and ongoing reporting. The proposal also sets out when a token stops being part of an investment contract, namely once the development team completes or permanently abandons the managerial efforts it promised (Finance Magnates).

Commenters named by Cointelegraph include the MiCA Crypto Alliance, which backed the disclosure changes and urged the SEC to better define concepts and data structures specific to crypto assets, and SkyBridge Capital founder Anthony Scaramucci, who called the rules a response to "organic adoption."

What it means for the market

Once the window closes, the SEC will review the feedback and may revise the proposal before issuing final rules. Cointelegraph notes the effort is moving ahead after Congress failed to pass the CLARITY Act, and legal experts warn agency rules are easier to overturn than legislation.
